Terms of Service

Acceptance of Terms

By accessing or using the HeyMariner platform, website, APIs, or any associated services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you are accessing the Service on behalf of a company, organisation, or other legal entity, you represent that you have the authority to bind that entity to these Terms, and “you” shall refer to that entity.

If you do not agree to these Terms, you must not access or use the Service. We reserve the right to update or modify these Terms at any time. Continued use of the Service following the posting of changes constitutes your acceptance of the revised Terms. We will endeavour to notify registered users of material changes by email or via a notice within the platform.

These Terms were last updated in June 2025 and supersede all previous versions.

Services Description

HeyMariner is a maritime intelligence platform that aggregates, processes, and presents data relevant to commercial shipping and maritime operations. The Service includes, but is not limited to:

  • Real-time and historical vessel position tracking via AIS (Automatic Identification System) data, including terrestrial and satellite AIS feeds.
  • Vessel database access covering IMO numbers, MMSI identifiers, flag states, vessel classifications, technical specifications, and ownership information.
  • Port and terminal intelligence including berth availability indicators, port congestion metrics, and estimated times of arrival and departure.
  • Maritime weather overlays including wind, wave height, current, and meteorological data relevant to voyage planning.
  • Fleet management tools including vessel watchlists, alert configurations, and voyage history exports.
  • APIs enabling programmatic access to HeyMariner data for integration into third-party maritime management systems.

The specific features available to you depend on your subscription tier. HeyMariner reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, though we will endeavour to provide reasonable advance notice of significant changes.

User Accounts

To access certain features of the Service you must register for an account. When registering, you agree to provide accurate, current, and complete information and to keep your account details up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must notify HeyMariner immediately at support@heymariner.com if you suspect any unauthorised use of your account or any other security breach. HeyMariner will not be liable for any loss or damage arising from your failure to adequately safeguard your login credentials.

Accounts are personal and non-transferable. You may not share your account credentials with third parties or permit others to use your account to access the Service. Enterprise and team subscription plans may permit multiple named users under a single organisational account, subject to the terms of that plan.

HeyMariner reserves the right to suspend or terminate your account if we have reasonable grounds to believe you have violated these Terms, provided false information during registration, or engaged in activity that endangers the integrity, security, or availability of the Service.

Prohibited Uses

You agree not to use the Service for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the platform. Without limiting the foregoing, the following uses are expressly prohibited:

  • AIS data manipulation and false reporting: using the Service to fabricate, manipulate, or disseminate false AIS position reports, ghost vessel tracks, or any synthetic positional data designed to deceive other mariners, maritime authorities, or automated vessel tracking systems. Knowingly publishing or re-broadcasting falsified MMSI-linked position data is a serious maritime safety offence and will result in immediate account termination and referral to relevant authorities.
  • Sanctions evasion: using vessel tracking data or fleet intelligence obtained through HeyMariner to facilitate, plan, or conceal voyages or cargo movements designed to evade international sanctions, export controls, or United Nations Security Council resolutions.
  • Piracy and unlawful interdiction: using the Service, including real-time vessel position data or predicted routing information, to plan, facilitate, or support acts of maritime piracy, armed robbery at sea, unlawful vessel seizure, or any other activity classified as a maritime security threat under international law.
  • Illegal fishing assistance: using vessel monitoring features to assist vessels engaged in illegal, unreported, and unregulated (IUU) fishing, including tracking of vessels on port state control black lists for purposes of avoiding inspection.
  • Automated scraping: using bots, crawlers, or automated scripts to systematically extract or scrape data from the platform beyond the scope of any API access tier you have subscribed to.
  • Resale without authorisation: re-selling, sublicensing, or commercially redistributing HeyMariner data or platform output without our express written consent.
  • Reverse engineering: attempting to decompile, disassemble, or reverse engineer any part of the Service, or to circumvent any technical access controls or licensing enforcement mechanisms.
  • Harmful or malicious activity: uploading malware, conducting denial-of-service attacks, or attempting to gain unauthorised access to any HeyMariner system, database, or third-party data feed.

Violation of any prohibited use may result in immediate suspension or termination of your account, civil liability, and, where applicable, criminal referral to relevant maritime or law enforcement authorities.

Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HEYMARINER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

HeyMariner does not warrant that AIS data, vessel positions, port information, or weather data presented through the Service are complete, accurate, current, or free from errors. AIS data is dependent on vessel transponder operation and may be subject to coverage gaps, signal interference, spoofing by third parties, or delays in satellite reception. Vessel positions shown on the platform may not reflect a vessel's actual real-time location.

The Service is not designed or certified for use as a primary navigational aid, collision avoidance system, or safety-critical maritime application. Nothing in the Service constitutes professional maritime, legal, regulatory, or financial advice.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEYMARINER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, BUSINESS INTERRUPTION, OR DAMAGE TO REPUTATION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF HEYMARINER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In particular, HeyMariner shall not be liable for any loss or damage arising from: reliance on vessel position data for navigation or collision avoidance decisions; cargo or commercial decisions made based on estimated times of arrival or port congestion data; or any failure, interruption, or inaccuracy of AIS data feeds supplied by third-party providers.

To the extent liability cannot be excluded by law, HeyMariner's total aggregate liability to you for all claims arising out of or relating to the Service shall not exceed the greater of (a) the total fees paid by you to HeyMariner in the twelve months immediately preceding the event giving rise to the claim, or (b) one hundred pounds sterling (£100).

Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms. Given the maritime nature of the Service, the parties acknowledge the applicability of relevant UK maritime legislation, including the Merchant Shipping Act 1995 and applicable provisions of the International Convention for the Safety of Life at Sea (SOLAS), to the extent they bear on the subject matter of any dispute.

Nothing in this clause shall limit HeyMariner's right to seek injunctive or other equitable relief in any jurisdiction where necessary to protect its intellectual property rights or prevent unlawful use of the Service.
